The specific services provided depend on the package purchased.

Nature of Coaching Services

Spiritfyt provides nonclinical health and wellness coaching. Our role is to support clients in identifying goals, developing habits, addressing behavioral obstacles, and applying general wellness principles to their everyday lives.

Spiritfyt does not provide individualized clinical nutrition care, medical nutrition therapy, or services that require a licensed or otherwise appropriately credentialed healthcare professional. We do not create therapeutic diets, prescribe meal plans for medical conditions, diagnose nutritional deficiencies, or provide clinical nutrition treatment.

General educational resources may discuss nutrition concepts, food choices, meal ideas, grocery shopping, and healthy lifestyle practices. These materials are intended for general educational purposes and do not constitute individualized dietary prescriptions or medical nutrition advice.

Clients who require individualized meal planning, therapeutic diets, medical nutrition therapy, or specialized nutrition recommendations should consult a registered dietitian nutritionist or another appropriately licensed professional.

2. NOT MEDICAL CARE OR PROFESSIONAL TREATMENT

Spiritfyt's services are not a substitute for medical care, mental health treatment, physical therapy, dietetic services, or other professional healthcare services.

Spiritfyt does not:

  • Diagnose, treat, cure, or prevent diseases or medical conditions.

  • Prescribe medications, supplements, or medical treatments.

  • Interpret medical tests or laboratory results for diagnostic or treatment purposes.

  • Provide psychotherapy, counseling, or crisis intervention.

  • Prescribe therapeutic diets or manage medical conditions through nutrition.

  • Provide individualized exercise rehabilitation or medical fitness prescriptions.

  • Guarantee that a particular habit, strategy, or lifestyle change is appropriate for every individual.

Any information shared through coaching is provided within the scope of general health and wellness education and behavior-change support.

Clients are responsible for consulting qualified healthcare professionals regarding medical concerns, symptoms, diagnoses, medications, treatment decisions, and questions about whether a particular activity or lifestyle change is appropriate for them.

Nothing in these Terms is intended to exclude services that applicable law permits or requires, or to authorize Spiritfyt to perform services outside its legal scope.

3. COACHING PACKAGES AND SERVICES

Gold — 6 months $450

Installment plans divide the agreed program price into scheduled payments. They do not automatically create a month-to-month membership or permit cancellation of the remaining contractual balance at any time.

Unless otherwise agreed in writing, the Client is responsible for completing the installment payments associated with the selected program.

By enrolling in an installment plan, the Client authorizes the applicable payment provider to process payments according to the payment arrangement disclosed at checkout or in the purchase agreement.

Payment Due Dates

The first payment is due at enrollment unless otherwise stated. Subsequent payments are due monthly according to the disclosed payment schedule.

Clients are responsible for maintaining valid payment information and ensuring that scheduled payments can be processed.

If a payment fails, Spiritfyt may notify the Client and request that the payment method be updated. Where permitted by law and the applicable platform's rules, Spiritfyt may pause future coaching deliverables or support while a payment remains overdue.

Any late fees, payment-processing fees, or other additional charges will be imposed only when disclosed in advance and permitted by applicable law.

Missed or Overdue Payments

Failure to make a scheduled payment does not automatically cancel the Client's payment obligations.

Spiritfyt may suspend coaching access, pause future deliverables, or terminate services for material nonpayment after reasonable notice and an opportunity to resolve the issue, subject to applicable law and platform requirements.

Spiritfyt will not use unlawful collection practices or impose charges that are prohibited by law.

No Unauthorized Charges

Spiritfyt will not knowingly charge a Client for services or recurring payments that were not authorized under the applicable purchase agreement.

Any recurring payment arrangement must be disclosed and authorized before it begins.

5. REFUND POLICY

Spiritfyt aims to handle refund requests fairly while recognizing that coaching services may involve personalized preparation, reserved coaching time, digital resources, and deliverables that cannot be returned once provided.

All refund decisions are subject to applicable law, the applicable purchase platform's rules, and any nonwaivable consumer rights.

A. Before Work Begins

A Client may request a full refund before personalized work has begun.

Eligibility will be assessed based on the stage of service, the purchase agreement, the applicable platform's policies, and any legal requirements.

B. Digital Products and Completed Deliverables

Once a digital packet, educational resource, personalized coaching video, or other purchased deliverable has been provided, the completed portion of the service is generally not refundable solely because the Client changes their mind.

This does not eliminate any statutory cancellation, refund, or consumer-protection rights that may apply.

C. Partially Completed Coaching Programs

If a Client requests cancellation of a multiweek or multimonth program, Spiritfyt will review the services already delivered, the unused portion of the program, the agreed payment terms, and applicable law.

Where a refund is due or appropriate, the amount will be calculated fairly with reference to the value of completed services and any prepaid services that remain undelivered.

Any applicable cancellation charge must be disclosed in advance and permitted by law. Spiritfyt will not automatically retain all prepaid funds solely because a Client withdraws from a program.

D. Failure to Deliver Services

If Spiritfyt cannot provide a purchased service, Spiritfyt may offer rescheduling, an appropriate alternative, or a refund for the affected undelivered service, as appropriate under the circumstances and applicable law.

If a promised deliverable is materially deficient, Spiritfyt may first offer a reasonable correction or replacement when appropriate. This does not limit remedies available under applicable law.

E. No Guaranteed Results

A Client is not entitled to a refund solely because they did not achieve a particular weight, body composition, fitness level, habit goal, or other personal outcome.

Results vary based on individual circumstances, participation, consistency, health, environment, and other factors outside Spiritfyt's control.

F. Emergencies and Extenuating Circumstances

Requests involving serious illness, family emergencies, or other significant circumstances may be considered individually.

Depending on the circumstances, Spiritfyt may offer a temporary coaching pause, rescheduling, an extension, or a prorated refund where appropriate.

G. How to Request a Refund

Refund and cancellation requests should be submitted in writing to:

Email: spiritfyt@gmail.com

Please include your name, package, purchase date, and the reason for your request.

Spiritfyt will review the request and communicate the decision and any applicable refund amount. Refunds processed through third-party platforms must follow those platforms' procedures.

Nothing in this policy waives a Client's rights under applicable law or prevents a Client from exercising a lawful payment-dispute or consumer-protection remedy.

6. CANCELLATION, WITHDRAWAL, AND PROGRAM PAUSES

Clients who wish to discontinue coaching should notify Spiritfyt in writing.

For Silver and Gold, cancellation does not automatically eliminate payment obligations already incurred under the agreed installment plan. Any future payment obligations, refund eligibility, and treatment of unused services will be determined according to the purchase agreement, the services provided, and applicable law.

Spiritfyt may consider temporary pauses or extensions when circumstances reasonably warrant them. A pause is not guaranteed and must be confirmed in writing.

Any approved pause should specify:

  • The start and end of the pause.

  • Whether scheduled payments continue or are deferred.

  • How coaching deliverables and the program end date will be adjusted.

Spiritfyt may suspend or terminate coaching when necessary because of nonpayment, abusive or threatening conduct, repeated violations of program boundaries, misuse of resources, or circumstances that make continued coaching inappropriate. Where required, notice and any applicable refund for undelivered services will be provided.

Clients may discontinue participation at any time, subject to their contractual obligations and applicable law.

7. CLIENT RESPONSIBILITIES

Clients acknowledge that coaching is a collaborative process and agree to:

  1. Provide accurate information relevant to their goals and participation.

  2. Communicate honestly about their progress, challenges, preferences, and limitations.

  3. Make their own decisions about whether to implement coaching suggestions.

  4. Seek appropriate professional care when medical, psychological, nutritional, or other specialized needs arise.

  5. Notify Spiritfyt of relevant changes that may affect safe participation, without being required to disclose unnecessary sensitive information.

  6. Treat Spiritfyt and its representatives respectfully.

  7. Use coaching materials only for their intended personal purposes.

  8. Complete payments according to the agreed payment schedule.

  9. Understand that progress requires individual participation and is not guaranteed.

Clients are responsible for determining whether a suggested general wellness practice is appropriate for their circumstances and for seeking professional guidance when needed.

8. HEALTH CONDITIONS, SAFETY, AND PROFESSIONAL REFERRALS

Clients should consult an appropriately qualified healthcare professional before making significant changes to diet, physical activity, sleep practices, supplement use, or other health-related routines, particularly if they have a medical condition, are pregnant, have a history of disordered eating, take medications, or have been advised to follow specific medical restrictions.

Spiritfyt may decline to address a concern that falls outside the scope of its services and may recommend that the Client seek guidance from a qualified professional.

Clients must not disregard medical advice or delay seeking care because of information obtained through Spiritfyt.

If a Client experiences concerning symptoms or a medical emergency, they should contact an appropriate healthcare provider or emergency service rather than relying on coaching communications.

Spiritfyt reserves the right to pause or discontinue a coaching activity if it reasonably appears to fall outside the safe or appropriate scope of the service.

9. NO GUARANTEE OF RESULTS

Spiritfyt makes no guarantee of specific results, including but not limited to:

  • Weight loss or weight gain.

  • Changes in body composition.

  • Increased strength or athletic performance.

  • Improvement in a medical condition.

  • Elimination of a habit within a particular timeframe.

  • Achievement of a particular lifestyle or personal-development goal.

Coaching resources, strategies, and educational materials are provided to support informed decision-making and behavior change. Outcomes vary between individuals.

Any testimonials, case studies, or examples of previous client experiences are illustrative and do not guarantee similar outcomes for other clients.

10. LIMITATION OF LIABILITY

To the extent permitted by applicable law, Spiritfyt Publishing and its owners, contractors, and representatives will not be liable for indirect, incidental, special, consequential, or punitive damages arising from participation in coaching services.

Spiritfyt is not responsible for outcomes resulting from a Client's decisions, actions, omissions, failure to seek appropriate professional care, inaccurate information, or use of educational materials outside their intended purpose.

Clients remain responsible for their own choices and for obtaining professional advice when needed.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law, including liability that cannot lawfully be waived.

Nothing in this section removes any rights or remedies that the Client may have under applicable consumer-protection law.

11. ASSUMPTION OF RESPONSIBILITY

Clients understand that implementing general wellness practices, changing routines, and engaging in physical activity may involve risks that vary by individual.

Clients are responsible for choosing activities appropriate to their circumstances and obtaining medical clearance or professional guidance when needed.

Clients should discontinue an activity that causes concerning symptoms and seek appropriate professional assistance.

This section is not intended to waive liability for negligence or other conduct where such a waiver would be prohibited or unenforceable under applicable law.

12. PRIVACY AND CONFIDENTIALITY

Spiritfyt respects Client privacy and will handle personal information in accordance with applicable law and any privacy policy that applies to the service.

Information shared during coaching will be used as reasonably necessary to provide the purchased services, communicate with the Client, administer payments, and fulfill legal obligations.

Spiritfyt will not intentionally disclose private coaching communications to unrelated third parties except as authorized by the Client, required to provide the service, permitted or required by law, or necessary to address a legitimate safety or legal concern.

Clients should avoid sending unnecessary sensitive medical information through ordinary email or messaging platforms.

Third-party platforms, including Fiverr and payment providers, may process information under their own privacy policies and terms.

Spiritfyt will take reasonable steps to protect information but cannot guarantee the security of every electronic communication or third-party system.

13. COACHING COMMUNICATIONS AND SUPPORT BOUNDARIES

Communication is provided through the channels specified for the purchased package.

“Ongoing support” means reasonable coaching-related communication within the scope of the selected program. Unless expressly agreed in writing, it does not mean unlimited messaging, immediate responses, 24-hour availability, or emergency support.

Response times may vary based on the package, business hours, workload, and the nature of the inquiry.

Coaching messages are not a substitute for urgent medical, psychological, or emergency assistance.

Spiritfyt may establish reasonable communication boundaries to ensure that services can be delivered consistently and professionally.

14. INTELLECTUAL PROPERTY AND USE OF MATERIALS

All original Spiritfyt materials, including coaching videos, written resources, mission structures, campaign frameworks, worksheets, educational packets, branding, and other proprietary content, remain the intellectual property of Spiritfyt Publishing or their respective rights holders.

Purchasing a package grants the Client a limited, nonexclusive, nontransferable license to use the materials for personal, noncommercial purposes.

Clients may not, without written permission:

  • Reproduce or resell Spiritfyt materials.

  • Share paid resources publicly or distribute them to unauthorized individuals.

  • Copy or adapt proprietary materials for commercial coaching or competing products.

  • Claim Spiritfyt's original materials as their own.

  • Record, redistribute, or publish coaching sessions or videos without authorization.

These restrictions do not limit rights that cannot lawfully be restricted.

15. TESTIMONIALS AND CLIENT RESULTS

Spiritfyt may invite Clients to provide feedback or testimonials about their experience.

Providing a testimonial is voluntary and is not a condition of receiving coaching or a refund.

Spiritfyt will obtain appropriate permission before using identifiable testimonials, photographs, recordings, or personal stories for promotional purposes, in accordance with applicable law.

Clients should not assume that their private coaching communications will be used for marketing.

16. THIRD-PARTY PLATFORMS AND SERVICES

Some services may be purchased or delivered through third-party platforms such as Fiverr or other payment, messaging, or digital-delivery providers.

Clients agree to comply with the applicable platform's terms, policies, and dispute procedures.

Where a platform's mandatory rules conflict with these Terms, the platform's applicable requirements will govern the transaction to the extent of the conflict.

Spiritfyt is not responsible for outages or actions of third-party services beyond its reasonable control, subject to applicable law.

17. CHANGES TO SERVICES AND TERMS

Spiritfyt may update its coaching methods, educational resources, and service procedures as its business develops.

Any material change affecting an existing Client's paid package, price, or agreed deliverables will be communicated as appropriate and handled in accordance with the purchase agreement and applicable law.

Updated Terms will apply to future purchases from the stated effective date. Changes will not retroactively remove rights or benefits already agreed to for an existing purchase where prohibited by law.

18. TERMINATION OF SERVICES

Spiritfyt may terminate or suspend a coaching relationship for material nonpayment, harassment, threats, misuse of proprietary resources, repeated violations of reasonable program boundaries, or other substantial circumstances that prevent safe and professional service delivery.

Where reasonably practicable, Spiritfyt will provide notice and an opportunity to address a remediable issue before termination.

Upon termination, the Client's access to future coaching services may end. Any refund or outstanding payment obligation will be handled in accordance with the applicable purchase agreement, the services already provided, and applicable law.

Termination does not eliminate rights or obligations that by their nature continue after termination, including intellectual-property protections and outstanding lawful payment obligations.

19. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms will be interpreted under the laws of the state of Ohio, without disregarding any mandatory consumer-protection laws that apply to the Client or transaction.

If a dispute arises, the parties are encouraged to attempt to resolve it through good-faith written communication before pursuing formal proceedings.

Nothing in this section prevents either party from exercising a legal right or remedy that cannot lawfully be restricted, including rights under applicable consumer-protection law or the rules of the applicable purchase platform.

Any mandatory jurisdiction, venue, or dispute-resolution requirements imposed by applicable law will remain controlling.

20. SEVERABILITY

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

The invalid provision will be interpreted or limited only to the extent necessary to make it enforceable where legally permissible.

21. ENTIRE AGREEMENT

These Terms, together with the applicable package description, purchase agreement, payment schedule, and any written amendments agreed to by the parties, form the agreement governing the Client's participation in the purchased services.

If a package-specific written agreement expressly changes a provision of these Terms, that change will apply to the extent stated in the agreement and permitted by law.

22. ACKNOWLEDGMENT AND ACCEPTANCE

By purchasing or enrolling in a Spiritfyt coaching package, the Client acknowledges that:

  • They have read and understood these Terms and Conditions.

  • They understand that Spiritfyt provides nonclinical health and wellness coaching, not medical care or individualized clinical nutrition services.

  • They understand the scope, duration, price, and payment arrangement of their selected package.

  • They understand that results vary and are not guaranteed.

  • They accept responsibility for their own decisions and for seeking qualified professional care when appropriate.
